Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EpiphanyFX platform and services operated by EpiphanyFX, LLC ("EpiphanyFX," "we," "us," or "our"), a company based in Huntsville, Alabama. By creating an account or using our services, you agree to be bound by these Terms.

1. Services

EpiphanyFX provides managed web hosting services, including website creation tools, cloud infrastructure, and related features, as described on our website. Services are provided on a subscription basis according to the plan you select.

2. Eligibility

You must be at least 18 years of age and capable of entering into a binding agreement to use EpiphanyFX. By using our services, you represent and warrant that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@epiphanyfx.com if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to use EpiphanyFX to:

• Violate any applicable law or regulation
• Transmit or store content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable
• Infringe upon the intellectual property rights of any third party
• Distribute spam, malware, or any malicious code
• Engage in activities that interfere with or disrupt our services or infrastructure
• Attempt to gain unauthorized access to any part of our systems

We reserve the right to suspend or terminate accounts that violate these provisions.

5. Payment and Billing

Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. All fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to modify pricing with reasonable advance notice.

6. Suspension and Termination

We may suspend or terminate your account at our discretion if you violate these Terms, fail to pay fees when due, or if we are required to do so by law. Upon termination, your access to the platform will cease and we may delete your hosted content after a reasonable notice period.

You may cancel your account at any time through the account portal. Cancellation takes effect at the end of the current billing period.

7. Content Ownership

You retain ownership of all content you upload or publish through EpiphanyFX. By using our services, you grant EpiphanyFX a limited license to host, store, and serve your content solely for the purpose of providing the services.

We do not claim any ownership rights over your content and will not use it for any purpose beyond operating the platform.

8. Intellectual Property

The EpiphanyFX platform, including its software, design, and branding, is the intellectual property of EpiphanyFX, LLC. You may not copy, modify, distribute, or reverse engineer any part of the platform without our express written consent.

9. Uptime and Service Availability

We strive to maintain high availability of our platform but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure events, or circumstances outside our control may result in temporary service interruptions. We are not liable for losses resulting from service outages.

10. Disclaimer of Warranties

EpiphanyFX is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, EpiphanyFX, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the services. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the three months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless EpiphanyFX, LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the services, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Madison County, Alabama.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Continued use of the platform after changes constitutes your acceptance.
